well, folks- we made it home alive and unscathed from our pre-trial.

the brief summary is: we will be going forward to a jury trial and i will need to get an attorney.

the longer version: ryan met us there and offered bunches of moral support (thanks, ryan!!!!). we waited about an hour and a half, which was good because it gave me a chance to hear how the process went and see how the judge interacted with everyone. she was really nice and fair, and i felt like she really gave everyone a chance to speak and she listened- something i was very afraid a judge wouldn’t do…

the judge looked a bit flabbergasted that this issue was coming before her.

KJ said that zoning dude told me no. that is absolutely not true. ABSOLUTELY not true!

i explained that we tried to find out the various codes and whatnot, that we went out of our way to be in compliance, that it is really hard to ascertain what is the right thing to do when the city’s language is so vague…

she advised me of my rights regarding a trial, and i told her i would like a jury trial. we are reconvening on july 26th for another pre-trial. that was very nice of the judge because she could have just made us go straight to trial, but this way my attorney (soon to be announced, i guess…) can come to a pre-trial, and get the lay of the land. possibly even make a motion to dismiss?

in any case, the saga will continue- kind of a let-down because i really thought today would decide things and we could be done already.

so, keep checking back here for updates, and i will keep blogging about our adventures in garden-land…

stay tuned…
